TERMS AND CONDITIONS

These terms and conditions (the “Terms”) establish the rules that must be followed by any person (the “User”) using the facilities of Recess Thermal Station Inc. (“RECESS”) after purchasing a single-use package from RECESS or, as the case may be, signing up for a RECESS membership (the package or membership being hereinafter individually referred to as the “Contract” unless otherwise indicated) for the services provided for in the Contract (the “Services”).

  1. Account. In order to obtain the Services, the User must have an account with RECESS. The information provided must be complete, true and up to date at all times. If the User creates an online account, the User must take the necessary precautions to adequately protect his or her login information from others and is fully responsible for that information.

  2. Minimum Age. The minimum age to access the Services is sixteen (16).

  3. Behavior. The User must behave in a calm and civilized manner at all times. No abusive/inappropriate language or shouting will be tolerated. The User must be respectful of RECESS employees and other users. Waste must be disposed of in the appropriate locations.

  4. Prohibitions. Alcohol, tobacco, drugs and food are prohibited on RECESS facilities.

  5. No Sharing. Under no circumstances may the User share his or her Contract or allow it to be used by others. RECESS reserves the right to request identification from anyone wishing to access the Services. 

  6. ‍‍Lockers. The User can use one of the lockers made available by RECESS. The User must remove all of his or her belongings from the locker every day at the end of each session of use of the Services. If the User does not remove his or her belongings from the locker, these will be retained by RECESS for one (1) week. If the User does not collect his or her belongings within the specified time, RECESS may dispose of such belongings at its sole discretion.

  7. Disclaimer of RECESS. RECESS and its employees are not responsible for any theft, loss, or damage to the User's belongings.  

  8. Responsibility of the User. The User agrees to indemnify RECESS for any damage the User may cause through his or her own fault to the property and facilities made available to him or her during the Services.

  9. Risk Recognition. The User acknowledges and accepts that the Services may pose risks of injury, damage, incapacity or illness, which may be serious in extreme cases, as well as death or damage to property owned or held by the User. Before participating in any of the Services or benefiting from them, the User must seek medical advice to determine whether any of his or her health conditions are compatible with the Services and without risk. Among others, the User fully understands and assumes that, as part of the Services offered, projections and light effects or visual effects, the frequency and intensity of which may be such as to cause epileptic seizures, may be used by RECESS. The User hereby releases RECESS from any and all claims arising out of or in connection with the foregoing. The User must notify RECESS of any health condition before participating in or benefiting from the Services.

  10. Change of Hours. RECESS reserves the right to change its opening and closing hours at any time without notice. The User undertakes to respect the opening and closing hours of RECESS facilities.

  11. Termination. RECESS reserves the right to suspend or terminate the Contract immediately upon the occurrence of a serious reason, which includes, but is not limited to, a force majeure event or the breach by the User of any of the obligations stipulated in the Contract, including the obligations related to the User’s compliance with these Terms.

  12. Personal information

    1. Consent to the Collection and Use of Personal Information
      The User consents to the collection, use and disclosure by RECESS of his or her personal information in accordance with the Privacy Policy available at the following link: https://www.recessthermalstation.com/politique-de-confidentialite. This information is collected solely for specific, explicit and legitimate purposes.


    2. Camera surveillance
      For safety reasons, the facilities can be partially monitored by video cameras. These systems are designed exclusively to ensure the safety of people, property and premises. There are no cameras installed in areas where users can undress. Images are safely stored for a limited period of time and then deleted, except in the case of an incident investigation.
      By accepting these Terms, the User acknowledges that he or she has been informed of the existence of this monitoring system and agrees to it.


    3. Purpose of Collection
      This information is required in order to:

      • Manage the Contract and allow access to the facilities according to the Services selected;

      • Carry out administrative follow-up, including billing and renewals;

      • Communicate with the User in connection with his or her Contract or related services; 

      • Ensure the safety of the facilities and comply with legal and regulatory obligations.


      The User consents to the collection and use of his or her personal information for the aforementioned purposes.


    4. Reference to Privacy Policy
      The privacy policy forms an integral part of these Terms. By accepting these Terms, the User confirms that he or she has read this policy and agrees to it. This policy describes in detail the corporation’s privacy practices. 


    5. Disclosure to Third Parties
      The User’s personal information may be disclosed to service providers, including payment, computer management or data backup providers, only when required for the performance of the Contract.


    6. Transfer Outside Quebec
      Some suppliers may be located outside of Quebec. Where such third parties are located outside Quebec, RECESS ensures, through contractual agreements or other measures, that such information is adequately protected to ensure its confidentiality and security in accordance with legal requirements.


    7. User rights
      The User may, at any time, exercise his or her rights with respect to his or her personal information:


      1. Access his or her personal information;

      2. Request the correction of personal information that is inaccurate, incomplete or ambiguous;

      3. Withdraw his or her consent to the use of his or her personal information;

      4. Request destruction or anonymization when applicable;

      5. Receive his or her personal information in a structured and commonly used format;

      6. Receive notification of any confidentiality incident involving his or her personal information and that may present a risk of serious injury;

      7. File a complaint with our person in charge of the protection of personal information or the Commission d’accès à l’information;

      8. To exercise these rights, the User may contact us using the information provided below.


    8. Retention of Personal Information
      The User’s personal information is retained only for as long as necessary to manage his or her Contract, unless applicable law requires or allows a longer retention period.


    9. Withdrawal of consent
      The User acknowledges that the personal information collected is essential for the management of his or her Contract and the provision of the Services offered by RECESS.


      Consequently, the withdrawal of consent to the use of such essential information may prevent RECESS from continuing to provide the agreed Services and may result in the termination of the Agreement, and such withdrawal of consent may constitute grounds for termination to the extent that RECESS is no longer able to provide the Services.

  13. Modifications. RECESS may amend these Terms at any time. At least thirty (30) days prior to the effective date of any amendment to these Terms, RECESS shall provide the User with a clearly and legibly written notice containing exclusively the new or amended clause as well as the previous version and effective date of the amendment. RECESS’ written notice will inform the User, if applicable, of his or her right to refuse the amendment and terminate the Contract without costs, penalties or termination fees, by sending a notice to that effect to RECESS no later than thirty (30) days after the effective date of the amendment, if the amendment results in an increase in the obligation of the User or a reduction in the obligation of RECESS.
